Legal Question in Employment Law in California

Fired Due to Death in Family?

Recently, my nephew needed time off to go to his grandmother's funeral. He feared being fired. Is there a law that states that an employee cannot be fired for taking time-off for a death in the family?

Re: Fired Due to Death in Family?

You didn't state whether or not your nephew was actually fired, or whether or not he was subject to a legal contract with the company he is employed by. However, in general, employees in California are "at will", which means that they can be fired for any reason, or for no reason at all. There is no law I am aware of that states an employer can or cannot take action against an employee based upon a death in the employee's family.
