Legal Question in Employment Law in California

I was hired as a part time (20 hrs a week) appointment setter for a firm known as Sales Escalator. After working there one week (and only 7 actual hours on the phone itself), I schedules 5 appts. At the end of week, I was let go because I didn't have "a different energy" than that of the others although my performance (appointment wise" was equal to that of my ALL male colleagues! I brought that up and he agreed my performance was good but he let me go otherwise. I was originally hired by a man named Dan Steinberg who was roughly in my age range. I never saw Dan the week I was working. Instead, I was surrounded by guys 35(at most) and under. I would say that most were in their 20s. Now I'm 52 and I'm pretty sure this is case of discrimination whether it be age,gender or both. I got paid for the appts themselves but had I continued working there, I would have earned $50 a pop for each appt sold. I also noticed afterward that the original ad said that each appt made would be worth $25, not $10 as I was paid! I know I was only there for a week but I am sooo freaking angry! PLEASE HELP ME!!!!

You've got a difficult hurdle to prove that it is age discrimination if you were 52 when hired, and 52 when fired. IF you have any actual credible evidence, such as witness testimony or documentation, that would tend to prove that the younger supervisor's motive in termination was 'age related', then you could have grounds for a claim. Your speculation, or mine, is not evidence. If you think you have any way of showing that, feel free to contact me for the legal help you�ll need.
