Sir/Madame:

I am truly sorry to have read this question, it is terribly sad.

There are some situations where an employer can let got of an employee even if they are on a protected leave of absence with a doctor's note, while in some situations it is not legal. However, this is a very fact specific analysis. To help guide you further, any attorney would need to know a few things such as why were you on leave, the size of your employer, how long had you worked for the employer, how long was your leave, was anyone else laid off at the time, and had the employer expressed any disagreement with you taking leave prior to your lay off. These are just a few of the questions when answered can help any attorney better assess your matter.

You are welcome to answer me directly, contact any attorney or contact our office to discuss further. We do wish you the best of luck.

Sincerely,

Beth W. Mora
