I'm a little confused by your post and need some clarification before actually saying "yes" or "no". Generally, an owner is NOT allowed to take any of the tips, but employees at the same level (ie. all employees who serve customers) can probably participate in a "tip pooling" arrangement. I have serious doubts about the owner's statement and think there may be something illegal, but as I said, I need some information in order to make a final determination. Feel free to call our office at (877) 877-2545. We handle cases throughout all of California.
