Legal Question in Employment Law in California

Salary rate increase or not?

I have been filing in as a supervisor for 2 1/2 months but have been paid at my same hourly rate. I have preforming supervisor duties should I get paid the superior rate while in this position including retro active pay?

Re: Salary rate increase or not?

Unless there's a collective bargaining agreement or state employment rules, the employer is not required to raise your rate of compensation. However, you are entitled to overtime. Also, of course, you can negotiate with the employer to increase your rate while you have that position -- even retroactively.
