Legal Question in Employment Law in California

I use to work for AT&T Mobility, I was terminated cause of my proformance, i contact the union to file a termination grievence for which they never did. I beleive there is to be some discrepence with my employee file that if the uion took a look at it they would of found something to have saved my job or have got it back for me. Im currently trying to get my employee file from my suervisor but have not gotten any luck yet. Not sure if i have a lawsuit or not. the following info was sent to the union supervisor letting her know that i wanted a termantion greivence filed. I was wondering if i have a lawsuit cause fellow employees where not making there #'s either but they didnt let them go.

Name:Alfred Ponce AP1014

start date: 10/10/05

termination date:05/17/10

departmant: Fraud

title:fraud Analyst

Supervisor:Lizzet Urita

I was terminated for my proformace the last 2 months march & april i was at 43 for my case we are require to meet a 47case per month, i had been on proformace plans but they where never consistant to the paper work that i was given at the time. On may 6, 2010, Lizzet took me into the confrence room & told me because i didnt meet my #'s for the last 2 prior months that the area managers & director of the call center was going to calibrate my #'s & come up with a desion weather they where going to keep me or not she said she would keep me inform as soon as she got any news. I told Sharon Rockmore of what Lizzet had told me & sharon had a meeting with Lizzet on May 13, 2010 i havnt talk to Sharon we keep playing phone tag so im not sure what was said in her meeting. On monday may 17, 2010, about 1:30pm Lizzet ask me to log off the phones, we went to the conference room, Sharon wasnt in that day so wasnt able to ask her to come with since she wasnt there, i didnt think of asking for a union rep cause i wasnt sure what was going on. She told me that it was my last day gave me my last check, request for my logins & waked me out.

Thanks!

Alfred Ponce

There is no point you posting here, your union grievance is your ONLY remedy. You have no employee rights outside the CBA.
