Legal Question in Employment Law in California

I work in a salon that I am pretty sure operates illegally. As stylists we are 1099ed to be independent contractors but yet we pay commission weekly instead of a steady rate. Also we have set schedules every day for 9 hours a day (1 hr lunch optional) but there are some days where we have no clients at all and we are stuck all day with no pay. Sometimes there are consecutive days where we don't have clients at all and we are mandated to stay all 9 hours with no pay. Does this sound right? Should I be seeking some kind of legal advice?
