Legal Question in Landlord & Tenant Law in California

guest tenant contd

- continued -

A couple hrs later I am on phone w/ friend when police arrive. Previous owner made complaint that friend was guest; is now trespassing & he wants him arrested. My friend puts officer on phone w/ me. I say:

1. Guy making complaint is no

longer the owner of the property.

2. My friend has lived there 4 mths

and believes he has legal rights

to be there.

3. My friend wishes to invoke his

civil right to request a judicial

hearing and let a judge decide

the matter.

The officer returns the phone to friend.

They want to talk with new owner so friend calls the RE agent. RE agent goes to house & tells all that new owner checked w/ his legal dept & they say friend was guest but now must go & has no legal rights to stay. (His ... legal dept??!!) RE agent tells deputies friend must be gone by 5pm 7-15 or he should be arrested (???!!!)

======

That's the story and what I want to know is .... does my friend have any legal rights here and what can he do when those deputies come back tomorrow ?

I feel like this is some kind of ''punk-d'' episode. This is a 68 yo vulnerable man and he is being abused. Tks.

Re: guest tenant contd

Friend has no legal right to the premises. He needs to be out.

There is no such animal as a judicial hearing here. You watch too much t.v.

If by "spook" you are referring to an African-American, I find it very offensive. Forget anything else, being a racist is going to rub a lot of people the wrong way.

RE agent probably was referring to lawyers for the RE office.

Sorry I cannot help more, and thanks for the "thanks". You are welcome.
