Legal Question in Landlord & Tenant Law in California

HELP, HELP, HELP...I'm willing to pay a lawyer than to fork out a penny to that ungrateful "relative". He has stopped paying his lease payment since 8/09, and uses the excuse of his "case worker" to get around from paying in full. He attempted to pay his September rent but I refused it becuase it did not include his August rent. I served him with a "rent or quit" official doc, but he didn't move out or pay, what can I do, or who can I contact? His October rent is due the 5th, I need immediate help, Please!!!!
