Is it against the law for my landlord to refuse to use my deposit for my last months rent

No, he can refuse to use your deposit for last month's rent because he is waiting for you to move out and to determine whether or not you have damaged the place.

It is not against the law. The deposit is for the purpose of making sure the place is clean and in the same condition it was when you moved in. It is not used for rent.
