Legal Question in Landlord & Tenant Law in California

I moved in with a friend of mine and paid her $3,250 dollars, this was to cover a $550dollar deposit and 6months of rent in advance($450 a month). she was supposed to write me a receipet but of course never got around to it. I figured she was my friend so she wouldnt do anything like kick me out. well I have lived there for only 5months and she is kicking me out without giving my deposit back to me. and I was not handed a eviction noticed it was taped to my wall and i didnt see it until today the 19th and im suposed to be out on the 30th. Also I was staying with my boyfriend for a few days and when i came home stuff was missing and things were placed in different areas. I came to find out that my lanlord has let one of her friends stay in my room since i have been gone. I would like to know whet right I have and If she can do this to me, I feel helpless like i have no leg to stand on.

Actually, fro the money involved you have had a relatively cheap tuition for a valuable lesson in the realities of life. Just be sure that you fully learn from it and do not repeat the same mistakes as many of us do.

You do not state what the agreement was for how long you were to stay there. She must attempt to give you personal service of aa thlirty day notice, so the notice she did glive is not valid, especially ilf she knew you would be gone at the beginning of the period of time stated in the notice. If you have a month to month tenancy, she must re-notice you. If the term is for a longer time, she can not legally give you a 30 day notice.
