Pet deposit not to be returned once dog is out?

My boyfriend and I broke up and i moved out of the apartment with our dog which i have custody of. I payed a $500 deposit when i got the dog. My landlord informs me that i cannot get the deposit back now that me and my dog are moved out but when and if my boyfriend moves out, is this right?

That is the likely result. Unless the boyfriend replaces the deposit on terms acceptable to the landlord the deposit remains with the landlord.

Make sure the landlord knows, in writing, that the deposit is half yours by sending him a certified letter/return receipt requested.

Also, in addition to Mr. Moerbeek's advice, the landlord is entitled to a walk through when your ex-BF moves out, in order to assess whether there was any pet damage.

I have to agree with landlord here (I seldom do agree with landlord).
