Legal Question in Landlord & Tenant Law in California

renting a apt that has not been approved

Hi i live in the peninsula, CA and I am currently renting a apt. I have just discovered that these apartments are not up to code and that the city has been closing these units for over 15 years. I went to city hall and found out that still until now they have not made the building up to code and that the city said it is not livable under

the current conditons. I was wondereing can I get all the rent i have paid back .due to the fact that I was not aware that I was living under these conditons that are dangerous. I am a single mom and would like to know my rights.

Re: renting a apt that has not been approved

You would have to sue landlord, and refunds are called rent abatement.

There is no way to get all the rent back. You did live there, and, thus, received lots of benefit (better than being homeless).

At some point, you should have been aware that these premises were not up to a decent standard of living.
