Legal Question in Landlord & Tenant Law in California

Video Taping in an Apartment Complex

Hi,

I am a resident apartment manager and we are currently evicting one of the tenants. He is becoming quite a nuisance with his video recording. Is there a law that we can stop him from video taping in 'common areas' (pool, walkways, laundry room, etc.)

Probably not. There is no expectation of privacy. You could stop him if he was creating a public nuisance, but merely video taping does not seem to be that.

I agree with Mr. Shers.

You do not have grounds to evict, merely based on videotaping.
