Legal Question in Medical Malpractice in California

Disability

We turned our disability extension papers over to our doctor to finish up and send out a on October 30th, 2006. We informed our doctor of the situation we were in, my wife has been sick and unable to work and I have not worked due to her illness. With both of us not working no income was coming in and rent was not going to be able to be paid with out this disability. The doctor that day told us she would fill it out and send it off. It is now November 13, 2006 and she has not sent it out. She will not be there for the rest of this month and that puts us in a predicament because rent was going to be paid with that disability. Is there any legal action that can be taken due to her negligence.

I'm sorry you have such problems with your doctor, but I'm afraid the negligence is yours, in not following up on regular basis to make sure YOUR application was timely filed. There is probably no 'legal action' for you to take except finding a new doctor.
