Legal Question in Medical Malpractice in California

I feel mistreated, harassed and discrimination from Kaiser Permanente. It all started at my last two doctor visits. I had switched my male doctor to another doctor because he almost got me fired from my job giving me an invalid doctors note for work. I had explained to my new doc that I needed the note that he gave me for my records she said okay and when she went into the computer she couldn't find the notes he wrote. Now every single doctors note that I have received in the past 3 years from Kaiser was in her computer just not that note (I guess he deleted it). So she goes out of the room and returns with the supervisor of the depth and the male doc I previously had who wrote me the note. So we all introduce ourselves and my husband explains to the supervisor that he had given me the note without a due date and I needed another note... so the supervisor does something with the files in the computer and pulls up the doctor note. The male doctor tries to explain hisself saying he didn't give me that doctors note to take off of work. So then me and my husband tell him he is lying because on the doctors note it states "patient is not to return to work duties until her pregnancy symptoms subsides." Then the doctor gets upset and starts pointing his fingers in my husbands face and starts yelling that he didn't write the note. So security comes and escorts the doctor out of the office and left in the office is me my husband and the supervisor. My husband starts talking to the doctor about our baby and our previous 5 miscarriages that I have had and then the supervisor turns to me and says" well those five miscarriages, those five babies weren't meant for you." so immediately I get teary eyed and ask her why would she say that and my husband tells the supervisor that he was going to record the rest of the visit because he didn't feel comfortable with what she said and then she (the supervisor) got up and threw her hands in the air and said "I'm not doing this I can't help u anymore if it goings to be recorded and she leaves out of the room. When we leave they called security to escort us out of the building like we did something wrong when all we wanted to do was record the rest of the visit. A week later I go back for my doctors visit and my husband is with me. When we approach the lobby there is security waiting for my husband like he is some kind of criminal so he explains to the security about what happened the last visit and the security tells us that the doctor didn't feel comfortable with my boyfriend coming in with me that he was not allowed in the office with me. I explain to them (the security and counselor) that I didn't feel comfortable being seen without my husband being present. So then I ask if I could go speak with the doctor to see if she would allow my husband in the room during the visit, they agree. So I meet with the doc and I told her I didn't feel comfortable with my husband not being in the room with me and I asked her did she say she didn't feel comfortable with my husband coming in room with me and she said "no I didn't say that the security said they didn't want him to come in here and that next visit my husband can come in during the visit." After my visit I return back to my husband and he is sitting outside the lobby. The counselor and I talk to him about my appt and what's gong on with me, then the security comes out of nowhere and my husband asks him can he please give us some privacy because we are talking about my visit and its very personal, the security refuses to leave even with the counselor giving him the okay to leave he stays all in our conversation anyways and my husband asks him isn't there anything else he needs to do can he please give us our privacy and the security just starts turning red in the face and he calls back up security and he attempted to grab my husband at the same time his arm brushed up against my pregnant belly then my boyfriend moved me out of the way and said come on baby we are leaving and for the second time we were escorted out of the building by security like victims all over my boyfriend and I asking for our privacy in our conversation. Today, 2/6/2014, my husband and I went in for my appt and this time as soon as we got off the elevator there was the same security from last time standing there saying my husband was not allowed to go in the lobby area and he had to stay by the elevators. I explain to the staff that because of the previous visits he me and my husband were treated I did not feel comfortable without him being in the room. They then told me that security made the decision for my husband not to come in the room and when I asked the security they pinned it on the doctors and said the doctors is the reason why he can't come in the room. So they send out the supervisor and I ask her is the reason why my husband can't come in the room is because he wanted to record the rest of the visit because of the comment you made about my five miscarriages that those weren't my babies and she said she never said that and that's when my husband and I called her out then she says "if there was anything I said to offend you I apologize but I dont remember what I said." So then she tells security she doesn't want my husband in the building anymore and that as long as he comes with me I wont be allowed either and that I need to go to women's pavilion (antelope valley hospital) for care. I get upset and tell her that I'm covered through Kaiser and that's a county hospital not a private one like Kaiser and then she walks off and says something to the security and next thing I know they tell my husband and I that they cops our on their way. There was not any reason for law enforcement to be involved be my husband and I didn't touch anybody or touch any of there equipment but because we stated our opinions we are being faulted. I'm a high risk carrier in my pregnancy because of my past miscarriages and testing in this pregnancy I have to be supervised every two weeks. This is the only Kaiser Permanente where I live that does care for pregnant women. Its not right I have to go to a hospital for the uninsured all because me and my husband stated our opinions and wanted to record my visit. Do I have a case?

You should report your complaint to the customer service in writing and ask for investigation. You should also file a complaint with the Department of Managed Health Care.
