Advice about filing a personal injury suit

On Sept. of 2004, I was in a car accident. I was hit from behind by a woman who knowingly drove with bad brakes. My ankles were injured as a result from pressing on them will all my force so that I would not hit the car in front of me. Since then, I went to physical therapy and she gave me ankle bands to wear. I received a payment from the insurance company as my car was a total loss. Last week, I received a call from the company handling the insurance claim asking me whether I am going to file a bodily injury suit. I do not feel pain under normal situations, however, if I am on my haunches for too long or after I do exercise, walk for long periods of time or stand for long periods of time, my ankles become extremely painful. I do not want to have this pain continuously or to have to wear ankle bands forever. I need advice on whether I should file and whether I need a lawyer to file a suit. Thank you.

You may not necessarily need a lawyer. What are your total medical bills, your diagnosis and prognosis? Any loss of earnings? Has the insurance company offered you any settlement amount? Have they taken your statement?

The insurance companies usually try to take advantage of those who try to run their personal injury and workers' compensation cases by themselves. The injured always loses! You should contact a personal injury lawyer without delay. There are strict time limits that can bar your right to sue if you do not file a lawsuit in time. Since you have already sat on your hands for over a year and a half, in all probability your delay has caused witnesses to become forgetful, and evidence to become unavailable; and you may have made other mistakes like giving statements to the insurance company that will be used against you. That said, you might possibly still have a chance.
