Legal Question in Personal Injury in California

I was by a drunk driver and injured. I released my car to my insurance company to be transfered to their secure location for their investigation. I don,t know what to do next. Should i have an attorney also invesigate my vehicle. Other driver arrested for dui. I don,t know what to do.

Like everybody says call us, but seriously you should get an experienced personal injury attorney on board right away. Most PI attorneys will handle your case on a contingent fee basis which means they wont get paid until you do.

Now as to your car the question is is there a dispute over liability? I would get a copy of the traffic collision report ASAP. While the conclusions are not admissible in court as a practical matter the insurance companies usually accept the findings for settlement purposes.

Your insurance company will take pictures and get estimates of the damages so be sure to ask for copies of those. If the damage is not clear then I would get an attorney involved immediately.

You should tell them to preserve the car as you need it for evidence.

The next issue in your case is proving the Defendant was drunk. You need to get that evidence preserved as to their intoxication because if you can prove they were drunk then you can get punitive damages in addition to the damages to compensate your for your medical bills, lost wages, loss of use, repair or replace of vehicle and damages for your pain and suffering.

Be aware that their insurance company will not pay any punitive damages so it comes out of the defendant's own pocket, but hopefully it will teach them a lesson

It is always better to get an attorney as soon as possible so they can protect your rights, preserve evidence that you will need later, and maximize your recovery.
