Legal Question in Personal Injury in California

My Freind and I got in a car accident and she got a lawyer and he said that even if she wins or lose i still get something and she said that she gets half and i dont know what to do even do it was her falt in the car accident?

You might want to retain your own lawyer if you think she might have been at fault. You might wind up suing her as you can claim against her insurance, as well as claim against the other driver. This depends on the facts of the accident and whom her lawyer represents.

I understand that you were the passenger in your friend's car. Since you obviously weren't at fault you can make a claim against either your friend's insurance or the other driver's insurance. Your friend can only win if she proves the other driver at fault in whole or in part.

Because your claim may depend on making a claim against your friend's insurance in whole or part, the same lawyer can't represent both you and your friend, except in certain circumstances.
