Legal Question in Personal Injury in California

Hi,

i was found 100% at fault hitting a pedestrian, i talked to my adjuster today, she said she already offered my policy to the victim and now just waiting to hear from the other party. i will consult a lawyer on my own just in case because i am not sure what will happen here. i dont have a house, i am a grad student that has lots of student loan. i am just preparing for the worst, what will my liability be, will i have to support the victim for a long time? any advice?

Wait until you see if they will accept policy limits. Your insurance company is obligated to try to get a policy limits settlement if possible. There is no way we can guess the extent of the pedestrian's injuries or the losses from them. So beyond that, there is not really anything we can tell you.

Elaborating on what Mr. McCormick has said, if your insurance carrier settles for the policy limit, more than likely the injured pedestrian will sign a settlement agreement not to sue you and that's all he/she will ever receive. The worst will be that you might consider filing for bankruptcy protection to avoid further monetary liability -- if there is no settlement.
