Legal Question in Personal Injury in California

I was shot buy someone on a leased property to help watch a legal marijuana grow and was shoot with a machine gun. I am a victim now totally disabled and lost home, education and job title, sex problems, other physical and mental problems, disfiguring, loss social status, occuring financial dept and burden, pain and suffering, i will never be able to gain what i have lost at 50 yrs old .. I was at no fault never assisted or offered any legal help. I was notified of sentencing that day.

It has been a year of the worst hard ship , following passing of wife of 20yrs in jan 2013 and loss of home in 2014 because of incidents.

No one has offered me any real help.

I am with continued health problems as a result ontop of prior health status at a great negative. The person that shot was on ssi and got 6 YEARS w ith rehabilitation, I get to suffer as a living dead man, i constant suffering and struggles.

I am sorry to read about you recent experiences. If this was a legal operation (in this now upside down world) then you probably do have a workers comp case. The only defense I can identify from the limited facts in your question is whether or not you were the specific target for a non-industrial purpose. That said, I. remain skeptical as to whether or not anyone who decides to open up a pot growing plantation would have workers comp insurance, but it's certainly worth trying. If not, the uninsured employers fund should kick in.

You may want to contact the California Victim Compensation Program. I can't guarantee that they will help, given that your post implies that you may have been participating in an illegal grow operation. But it can't hurt. You can also apply for disability benefits through SSI and/or SSDI. There are attorneys who will help you during the application process for a percentage of the retroactive payment made when you are qualified for benefits. It's a regulated fee - google Social Security Disability Lawyers.

Suing the person who shot you appears to be pointless as he's on SSI and is more or less judgment proof.
