Legal Question in Personal Injury in California

My son and friend were out drinking. My son got in the car with the friend and then they were involved in an accident. No other cars involved. The driver was convicted of DUI. His insurance company now want make a settlement but says that my son will be responsible since he willingly got in the car. What will he be liable for?

That is, certainly, what the insurance company will argue. It will be up to your son's attorney or representative to show why that is not the case.
