Legal Question in Real Estate Law in California

Our 38 year old daughter died in Nov 2009. She was not married and was living with us, her mom and dad. She owes money on a credit card and a car. Can I sell the car to pay it off and clear her credit card without going through probate?

I am sorry for your loss.

If her total assets are less than $100,000, you do not have to go through probate. If she did not leave a Will, you might have to get the DMV to change the vehicle registration in order to sell it.
