Breaking a lease - as a matter of convenience

Our tenents have informed us that they are ''walking away'' from a residential property lease 3 months prior to the lease expiration because they've purchased a home.

We are aware of our obligation to attempt to relet the home as soon as possible, but there will be considerable clean up and repairs to be made. In addition the property is located in the Palm Desert where it is extremely difficult to find qualified tenents during the summer.

Whatis the proceedure to follow to collect the rent and other costs due if we are unable to re-lease the condo?

If the amount is $5000 or less, small claims court is the first thing to consider after negotiations break down. Get a self-help law book on how to present and win your small-claims case.
