Legal Question in Real Estate Law in California

I entered into escrow on a home, paid the required deposit. We had to perform all inspections. We ordered a septic inspection. The last we heard was that there were roots and they could not do the inspection. We cancelled the contract. We had not released this contingency. Weeks later we got, after advising the other realtor that we had not received our deposit back, a copy of the septic inspection that showed they removed the root balls, did a flow test and a visual inspection of the leach field. Since we cancelled the contract before all contingencies were removed, should we get our deposit back?
