How to remove deadbeat boyfriend from my home.

My boyfriend lives w/me, and my 2 children, in my home. For 4 years I've been basically supporting him. He's had several jobs but they never last long. He quit his last job 3 months ago. I've had enough,I'm tired of supporting him and I want him out of my house. He keeps saying he's leaving when he gets the money, but that will never happen. I've asked him to leave many times. He refuses, tells me to call the police. He's not physically violent but he can be verbally abusive. He smokes in the house and I've asked him not to. He's taken over the livingroom so the rest of us live in our bedrooms. My children don't deserve this and I want my home back. How do I get him out of my house?? Help Please!

If it is your home or you are the one that is renting or leasing the home, you can serve the boyfriend with a 30 day eviction notice. If he does not leave within 30 days then you can file and serve an unlawful detainer on him, and sue for back rent as well. One word of caution, he may become violent or threatining after being served with the 30 day eviction notice. If this occurs you should then call the police and/or go to Court and get a restraining order which would include his exclusion from the house.
