Legal Question in Real Estate Law in California

rental rights

The owner of my unit sold it and the new owner wants to move in. My old owner gave me a 30 day termination of tenency. I am on permanent disability because of an illness. Is it a law that disabled people are allowed 60 days instead of thirty to vacate?

Re: rental rights

It depends on where you live. Some cities have such regulations. For instance, West Hollywood requires a longer notice for disabled or elderly, plus statutory moving expenses.

I suggest you check with your City Hall or your local library to find out what the local codes say.

Re: rental rights

I can't find one, although Civil Code section 51.3 regarding senior citizens housing rights has some provisions regarding physically handicapped persons that might fit your case. This law was extensively amended within the last year and I have not had occasion yet to study all its possible uses and applications. You can probably view it on the Internet, or find it if you can get to a library.

Another really good possibility is just to try negotiating with the new owner. Sometimes they are happy to get a definite promise to be out in 60 days with no hassles (if you are in a position to make and keep such a promise) rather than risk having to enforce their 30-day notice with formal eviction against a disabled person.
