Legal Question in Sexual Harassment in California

Is there an age limit on sexual harassment? Say if a child under the age of ten molestes a 3 year old.

Wow, you need to be really careful about this one. I'm an attorney, and not a psychologist. That said, you have to define molestation. 10 year olds are often just curious, so this issue has to be explored deeper by experts before such conclusions are made. SEEK AN EXPERT before dragging a 10 year old through the legal system.

Theoretically, all molestation is punishable as a crime, but the lower the age of the offender, the less likely to be provable as something other than 'innocent' childish investigation and behavior. Yes, a 10 year old is clearly at risk of legal action. As Mr. Lupoff suggests, don't rashly make accusations, or do anything without consulting trustworthy outside opinion. BUT, the victim MUST be protected by some appropriate action.
