Legal Question in Sexual Harassment in California

supervisor dating employee

If a supervisor is dating an employee, what legal ramifications can occur if they have a messy break up? Also, could other employees sue an employer for sexual harassment if they believe that the supervisor is showing favoritism toward the employee they are having the affair with???

Re: supervisor dating employee

Workplace romances happen. The added factor of the inequality of the supervisor/subordinate relation complicates things (and some would say adds an element of coercion or claimed coercion). One or the other is likely to lose their job, guess who? And the other will then likely sue for sex harassment, and maybe win. Yes, other employees who feel they are adversely affected by the resulting favoritism could well join in the litigious fun.

This is why most large employers have policies that address these specific topics, and why Google returns 1,020,000 results for the search, [supervisor dating employee].

That's classic grounds for supervisors to get fired and the company to get sued. That's why good policies forbid it. IF you are a wronged individual, meaning the victim of favoritism toward the girlfriend, feel free to contact me. If you're the supervisor about to be fired, definitely contact me.
