Legal Question in Tax Law in California

I am being audited by the IRS for the support pmts I made & claimed in 2008. The IRS said the receipts that I saved are not sufficent because they only show an acct # with no name because i did direct transfers into her account all year long. I now need to get a court order to get a US bank statement from my Ex's closed bank account that puts a name to the account #.. Can I do this in small claims and what form do I need to fill out? I don't konw who I'm fighting the IRS or My ex because she wont send me anything that would help.
