I am not quite sure why you submitted this to the tax law forum (if there is another issue we should be aware of please advise).

Depending on the situation, you can petition the court to force a sale and split the proceeds. The really depends on a number of factors (agreements, situation, etc).

Frankly you need a property law attorney.
