A necessary element of hit-and-run is that you knew or reasonably should have known that you were in an accident. If you truly did not know and the force of the impact was not so strong that you should have known, you have a very defensible case. If you are being charged, it's time for a lawyer. You need a good criminal defense attorney. I'd strongly suggest you find someone who focuses on criminal law and who routinely practices in the court where this case will be heard.

I practice in the San Jose court area routinely.

1. How did you find out that there may have been a possible accident?

2. Did you have insurance at the time?

3. Was there any damage to your vehicle?

4. Has any law enforcement office tried to contact you?
