Legal Question in Traffic Law in California

Recently i was scrolling my blackberry for a menu item while at a traffic light. An officer pulled me over shortly after the light changed and although i explained that I was not texting he became very abusive, called me stupid and insisted that he saw me doing the texting because he was next to me. Anyway, i got a ticket for doing the texting, and wonder what can be done in traffic court which is scheduled for next month.

Cell phone usage in a car is described in vehicle code section 23123.5. This section does not apply to reading a telephone number or entering a telephone number. A violation is an infraction and the fine is $20. Fines do not always include the penalty assessment which can raise the $20 fine to $200. Read the vehicle code section and the nolo press book How to Fight You Traffic Ticket. or hire an attorney to represent you.
