what happens when a beneficiary takes all the money in a living trust bank account where she is not listed as a trustee ?

In order to answer this question an attorney would need a lot more information, including a copy of the Trust and a bank statement or other documentation showing how the bank account was held.

Unfortunately, many times people will create a Trust, but not transfer the bank account into the name of the Trust. Sometimes the account still has either a POD (Pay on Death) beneficiary designated or the account is held jointly with a relative who is helping manage the person's finances. In those examples, the person may have the legal right to the funds in the bank account.
