Legal Question in Wills and Trusts in California

My brother commited suicided earlier this year in TX. In order to satisfy the rules for probate, his 2009 and 2010 tax returns must be completed before dispursing funds.

He was alive only 52 days this year. My question is: Can his 2010 taxes be completed before the end of this year or must we wait until the end of the year to file?

I am sorry for your loss. Since any money earned after his death goes into his estate and not to him, i do not see why you can not file an early return now; the IRS is probably not geared up to make any 2010 refunds. You can search the web sites on this topic and cal the IRS.
