Legal Question in Wills and Trusts in California

Name change on Will and Trust Accounts

Can a person who is not named on a Will or Trust take it upon themselves to change the name on the Will and Trust accounts to their own and withdraw the $$s? What legal action can be taken?

I'm not sure to what person you're referring. Neither the administrator nor the trustee can make changes if the settlor has died. If you're a beneficiary, you might petition for an accounting.

Re: Name change on Will and Trust Accounts

It is difficult to answer your question, because it is a little vague. You also do not indicate what kind of accounts. If they are bank accounts, and jointly owned (2 names on the account) then they are entitled to change the names. If not, is there a power of attorney. I would need more information tt really provide you with any kind of accurate answer.
