Legal Question in Wills and Trusts in California

My dad made a trust but didn't put the trust in the deed. He did have the trust notarized do think a judge will honor that my dad had intentions on the trust being titled in estate before he passed away.

It is possible to file a petition with the court, asking that the property be included in the trust.

Instead of Probate, a Petition called a Heggstad Petition may be filed along with the Pourover will requesting a Court Order that the asset is an asset of the Trust to be distributed under Trust terms. An attorney can help you file this Petition to insure that the home passes as your father wished.
