Legal Question in Wills and Trusts in California

My father died in 2009, he left an estate that is still in probate due to many court cases.

My sister and I are beneficaries but were never contacted. One of my sisters was, by the executor is my ex step mom. Whom we don't speak to. I was in fact contacted by this ex-step mom's husband whom she is currently divorcing.

How do we notify the court that we were never properly notified and ask for an accounting of the probate?

You can file with the court on legal numbered paper the caption and number of the probate case a "Request for Special Notice" and which in the body of the pleading you state why you believe you are a beneficiary, the executor know of your existence and address but never notified you, you request notice of all future hearings and that the executor send to you a copy of all papers, documents, etc. already filed in the matter by anyone, and that an accounting and inventory be done within 30 days, etc.

You should look at the entire court file, find out why she did not mention you, see if she has been appointed by the court yet as administrator, consider whether you wish to be administrator, look up all the other cases you father was involved in, etc. Find out why she did not notify you. You are going to need legal advice..
