Yes. Once the will is submitted for probate, you have to appear in the probate as a party to contest.

There ARE time limits once a court probate proceeding has been filed. However, this is a different story if no probate has been filed or no notices given in relation to a trust.

Probate will generally take place in the county in which the deceased resided upon their death.

You should probably consult with a local attorney to discuss your options.
