Legal Question in Wills and Trusts in California

My mother owes us a considerable sum of money loaned to her over the years. She is now on Medi-Cal, and under the new laws they can attach her mobile home after her death. Can she quit claim us her mobile home while alive so we can recoup our loan after her death?

I suggest you contact a local estate planning attorney who specializes in Elder Law and Medi-Cal planning. Generally, however, Medi-Cal will likely see the exchange as one for money and consider the debt foregiveness and count it as income which may affect her benefits.

Your mother has some options, but as Mr. Jordan states, it is important for your mother to discuss them all with an attorney who knows Medi-Cal regulations. There are a lot of other components to Medi-Cal planning that need to be explained.
