Legal Question in Wills and Trusts in California

I would like to pass on my property to my grandchildren but want my son to have full control while he's alive. Can I do this and how? Thanks.

I agree with Joel's answer. You need a trust, and you should retain counsel to have this done properly.

A well drafted trust is probably the best answer in most cases. There are other options, such as a life estate to the son. You should consult with a good estate planning attorney.

You can definitely do this with your property. Your wishes here are not uncommon. A lot of individuals prefer that their property ultimately ends up with their grandchildren. As the other attorneys have said, a well drafted trust is your answer. Much depends on what property is involved and whether there are other issues that are important to you such as tax planning, medical care planning or children or grandchildren with special needs, for examples. Decisions such as whether you want your son act as the trustee and manage your property on behalf of your grandchildren or whether you would like your son to have a life estate in the property before the property goes to the grandchildren will need to be made. An estate planning attorney can help you decide what type of trust will best meet your needs and goals.
