Legal Question in Wills and Trusts in California

Pending Probate / Inheritance Case

My deceased grandfather was a Cree / Creek Native American, as was my deceased father. Recently I was informed by a family relative of a pending inheritance / probate case involving the descendents of my deceased father and grandfather. Unfortunately, I have no close ties to the family relative who was contacted regarding the inheritance, so my knowledge about the case is limited. How do I go about finding and contacting the parties handling the pending probate case? My grandfathers name was Jirtle Burton, my father was Gilbert Franklin Burton, and my step-brother, Troy Lamont Burton, was the individual contacted regarding the inheritance case.

Re: Pending Probate / Inheritance Case

You need some information about where the case is located.

This may be obtained by where they resided upon their death. The probate was likely filed in the county in which they resided.

However, there is the possibility that, if they resided on a Native American Reservation, that different laws may apply to the transfer of property.

You may want to consult with an attorney to discuss your rights and options.

Re: Pending Probate / Inheritance Case

Do you know where your father or grandfather lived (what county) when they passed away?

I understand thet you have minimal contacts with your step-brother, but do you have any contacts with other family members?

Unfortunately, Probate matters are difficult to locate unless you know the county in which the decedent resided; this is generally where the Probate is initiated.

Additionally, if you have information about any real property owned, then a search of the grantor-grantee index may prove useful in locating the county where the Probate may have been filed. The more information you can provide, the easier it will be to locate the information you need.

I do recommend retaiing an attorney to assist you with these matters. Our firm would be able to assist you as we specialize in wills, trusts and Probate matters.
