Legal Question in Wills and Trusts in California

I need help splitting a JT Ten (Joint Tenant) account that I have with a former business associate of mine. We are currently not speaking and he will not sign the papers to split it. It is almost 600 shares of a publicly traded company and once he signs (which he won't do) we can both go our own way and get our shares. Would getting an attorney be an easy way of doing this? And since he will not sign would he be liable for my attorney fees?
