Legal Question in Wills and Trusts in California

If my wife I paid for repairs of her mother's estate. In which she has 1/4 interest and the others agree to share cost. But they say there was no agreement to repay us. We have to go to trial on this matter. Now that the property has been rented out. She has been told she only gets net worth of rent. Why do we have to go trial and the personal representative does not ?

Maintaining the estate is a proper expense of the estate and should have been repaid prior to any distributions being made. They don't get to choose to repay you or not. You were preserving the assets of the estate. I don't know why you are going to trial on this matter so you should find an attorney to talk to in Pittsburg that does probate. Use the "find a lawyer" tab in the upper right corner.
