Legal Question in Wills and Trusts in California

Will or Trust

Is there a difference between a will and a trust? Can a trust go to Probate? If the trust was established in1998 and my father was not married at the time of trust--is his widow entitled to any of his assets --she married him 5 years ago. My father said that I was to have all his assets. He died 2-13-2008. What would she be legally entitled to?? My father lived and died in Porterville California. I am his only son.

Re: Will or Trust

trusts assets are administered outside probate. his widow is not entitled to "trust" assets unless she is named as a beneficiary. you're entitled to all the trust assets if you're named as the sole beneficiary. trust assets are assets that have been transferred to the trust via title or declaration.
