Legal Question in Workers Comp in California

Car accident while attending meeting

A worker has got himself into a car accident while driving to a business meeting his employer had asked him to attend. No one was injured but the personal car was damaged. Worker approached employer for compensation on fixing the car, employer refused saying he is not under payroll, thus not covered employee. Please advice on this situation. Thanks.

Re: Car accident while attending meeting

Technically, the worker would be covered for workers' compensation if there were a personal injury. However, I have never seen the labor board order a car repaired.

A third party suit may also be possible with a civil filing. Perhaps you should speak with a PI attorney.
