Legal Question in Workers Comp in California

Hi. Is it legal to ask an employee that has been out due to a non work-related injury to supply a doctors note to clear them to come back? I'm concerned that they will claim they got hurt at work. Thanks.

Is asking for a doctor's 'note' legal? yes, there is no crime in asking for a 'note.

will asking for a 'note' from a doctor stop the employee from pursuing Workers Compensation benefits within 1 year of the date of injury? NO.

IMPORTANT: requesting some 'note' from some physician about the employee's work status does absolutely nothing to prevent the worker from later asserting there was a work injury.
