Legal Question in Workers Comp in California

On-premises injury--outside regular work hours

I tripped and fell, after work on my way to my car, in my employer's parking lot. They are denying my claim for Worker's Comp because it was after my work period. I fractured my left foot and hurt my right knee. This happened on my employer's property/premises. I won't know until my doctor's appointment 3/29 how many if any, therapy appointments will be required. Can I ask for the W/C Board to review their denial of my benefits? I believe I have the right to sue them for personal injury. Please review and advise.

Re: On-premises injury--outside regular work hours

If you were on your way to work or to your home from work, then it is a worker's compensation claim. If you tripped over a defect in the parking lot then you may also have a personal injury claim. Call me directly at (619) 222-3504.
