Statute of limitations on death claim

my sons (a dependent at time of injury) father injury was in 1997, I was told a death claim must be filed within 240 weeks after injury date, he didn't die untill 10/02. cause of death-overdosed on methadone. Self-prescribing for pain. he was unable to obtain prescription for several months through workmans compensation doctors. he was collecting workers compensation,infact was offered a $70,000.00 settlement before his death. Is there a way-around the statute of limitation of a death claim. and could it be proved the link between the cause of death and his injury. (not known where/who/how he optained the methadone )
