Legal Question in Workers Comp in California

terminated on workers comp

two weeks after my surgery,from being hurt on the job, they terminated me. saying that i exausted my oppertunities. i was on light duty 12 weeks and off the schedule 12 weeks prior to the termination. do i have a case against them?

You have seveal options, one is a discrimination cliam in workers' comp. However, in order to prevail you must prove that you are able to perform your job, or go back to your job. The other is an ADA accommodation claim, or EEOC discrimination claim relating to the employer's failure to make a reasonable attempt at accommodating your injury.
